The Administrative Court of Magdalena declared inadmissible the protection action requested by the socket suspension possession of the Santa Marta Aqueduct and Sewerage Company (Essmar), ordered on November 22.

The decision was celebrated by the Superintendence of Residential Public Services, which will remain in charge of the entity, despite the pressure exerted by the Mayor’s Office to ensure that said intervention is irregular and has political ends.

The takeover of Essmar by Superservices remains firm

For its part, Superservices has indicated that the takeover was due to technical incapacityoperational, administrative and financial to guarantee the due quality, coverage and continuity of the aqueduct and sewerage services in the capital of Magdalena.

Upon learning of the ruling, Superintendent Natasha Avendaño stated: “Justice was served in favor of the samariums, the takeover of Essmar by Superservices remains firm.”

Likewise, he reported that the management of the special agent will continue to be followed up, so that the conditions of the aqueduct and sewage services in Santa Marta “continue to improve, as evidenced” since the intervention.

the main Superservice challenge is to guarantee the provision of drinking water service to users and achieve the recovery of the company with technical, legal and financial resources.

Mayor rejects intervention

Mayor Virna Johnson has insisted that this intervention, contrary to generating a benefit in the provision of public services, means a new paralysis of the project to solve the shortage problem that the city suffers and also keeps it in a health crisis due to the overflow constant sewage.

“They do not invest, they do not do, nor do they let do”, the president specified.

The District Comptroller of Santa Marta, through a final report, ratified an alleged fiscal detriment of more than 41 billion pesos in the Public services company (Essmar), currently intervened by Superservices.

The control entity found former managers Ingrid Aguirre, Carlos Páez Cantillo and José Dajud Durán as allegedly responsible for the irregularities.

These audits were carried out in order to comply with the Territorial Fiscal Surveillance and Control Plan for Validity 2021.

In that sense and after the analyzes carried out, the audit team was able to establish a series of findings determined as follows: with alleged disciplinary incident a total of 52, with alleged criminal incidence two and administrative findings 52.

As a result of the results of the investigations, it was established to open the relevant fiscal responsibility processes, certifying copies of the findings with alleged disciplinary incidence, to the Attorney General’s Office and transfer of the findings with alleged criminal incidence to the Attorney General’s Office. .
