Armando Quintero, who was the driver of the late vallenato artist Martín Elías and who was driving the van in which the singer had an accident, referred to the judicial process that was brought against him and recalled what happened the day of the accident in which Díaz died.

Martín Elías Díaz, son of the singer Diomedes Díaz, died on April 14, 2017 on the San Onofre-Lórica road, after a presentation made together with his band.

The van in which the artist was traveling suffered an accident and, later, he died in a care center.

This week, almost five years after the accident, a judge sentenced Armando Quintero, driver of the van in which Díaz was traveling, to 32 months in house arrest and a fine of 26.66 monthly minimum wages, for considering that the excess of speed caused the death of the singer.

Quintero spoke with the program ‘Good day Colombia’, on the RCN channel, and said that before working with Martín Elías, he was working for Sergio Luis Rodríguez, the accordion player who worked with Peter Manjarres and Jorge Celedón.

Some time later, he received a call from a member of Martín’s team to offer him to be the artist’s driver.

Regarding the accident, Quintero said that they were in Cartagena, since the artist and his family were resting for Holy Week. Then, they left for a concert in Coveñas.

We were in Cartagena because Martín and his family were on vacation. That day we went out to Bocagrande to eat and then we went to bed. You had to leave at 1:40 am for Coveñas”, he counted.

According to Quintero, Martín sang around 6 am on April 14 and, when he finished his presentation, he got into the truck and received a call from his wife. They started again bound for Cartagena.

I was following Rolando Ochoa’s truck at a normal speed and Martín told me to pick up the pace. I overtook Rolando and later I got out to relieve myself and in the meantime, Martín was changing his clothes”, he told ‘Good day Colombia’.

This is how the vehicle in which Martín Elías had an accident remained.

When they started up again, a motorcycle got in the way: “The motorcycle goes in front of me to one side and the other, I go the other way to pass by the side of the motorcycle and when we overtake, the motorcycle comes against the truck” .

Quintero pulled the car to the opposite side, but said that the artist also pulled the steering wheel of the car. That’s when he lost control and the accident happened.

“When Martín throws the rudder at me, the truck leaves from the left side (…) when I straighten up, the tire takes the hole and the truck stops from back to front,” he narrated.

The vehicle turned around several times and the artist was expelled from the truck, since he did not have a seat belt.

According to Quintero, the vallenato singer never wore a seat belt, Therefore, according to him, it is not true that Díaz had removed his belt to change his clothes, as some versions of the event indicated.

Martín never used the belt, he only put it on once and it was because he was going to sleep. When he was awake he always went without it”, he said, as quoted by ‘RCN’.

Who was the driver of Martín Elías Díaz said that he has not had quiet nights again and affirmed that the departure of a good human being such as the artist has always hurt him.

In addition, he stated that his lawyer will appeal the sentence that sentenced him to 32 months in prison and that he does not have the money to pay the economic penalty that was imposed on him.

On Saturday, people in the United States will mark the 10th anniversary of the death of Trayvon Martin, a 17-year-old Black youth who was shot to death in Sanford, Florida, in 2012. Martin’s death, and the subsequent exoneration of his killer at trial the following year, created a firestorm of public anger that many consider a seminal moment in the development of the Black Lives Matter movement.

Among them is civil rights attorney Ben Crump. In the foreword to an essay published this month by Sybrina Fulton, Martin’s mother, he wrote, “The not guilty verdict in the Trayvon Martin case was the catalyst for the Black Lives Matter movement, for the resounding call for justice when the people cried out: ‘Justice for Michael Brown,’ ‘Justice for Breonna Taylor,’ and ‘Justice for George Floyd.'”

Brown, Taylor and Floyd were all Black Americans killed by police officers. Floyd’s murder in Minneapolis in 2020, documented in video footage that showed him dying in the street with a police officer’s knee on his neck, ignited global protests that drew attention to the fact that individual Black Americans, particularly men and boys, are statistically far more likely to be killed by police officers than white Americans.

According to a study published in the Lancet, Black Americans were killed by police at more than three times the rate of non-Hispanic white people, between 1980 and 2018.

Though Martin’s death did not come at the hands of a police officer, his killer’s exoneration prompted calls for the reform of a legal system that, according to advocates for change, systematically undervalues the lives of Black Americans.

Martin’s death

Martin, who had recently turned 17 at the time of his death, had left home to buy candy and a drink at a nearby convenience store. On his way back, he encountered George Zimmerman, a volunteer for the local neighborhood watch. Zimmerman phoned police to report Martin as a “suspicious” individual.

Despite being told by a police dispatcher that he should not pursue Martin, who ran from him and was unarmed, Zimmerman gave chase. After a struggle, Zimmerman shot Martin in the chest, killing him.

Zimmerman was eventually charged with second-degree murder and manslaughter. In July 2013, a jury found Zimmerman innocent of both charges. The case hinged, in part, on the state of Florida’s “stand your ground” law, which holds that individuals who believe themselves to be in danger from another person have no duty to retreat before responding with force, including lethal force.

Martin’s family, including his father, Tracy Martin, and Fulton, his mother, helped lead an unsuccessful campaign to have Florida change its stand-your-ground law.

Signs of change

In the days leading up to the 10-year anniversary of Martin’s death, there have been signs suggesting the Black Lives Matter movement may have helped shift public attitudes on race, policing, and the use of force.

In Minneapolis last week, three police officers on the scene at George Floyd’s death were convicted on federal charges for their failure to intervene. Months earlier a jury found Derek Chauvin, the police officer who knelt on George Floyd’s neck, guilty of murder. The jury found all three officers had violated Floyd’s civil rights by willfully refusing to provide medical assistance. Two were found guilty on an additional charge stemming from their failure to intervene during the nine minutes Chauvin spent kneeling on Floyd.

Also last week, three Georgia men were found guilty of federal hate crimes for the murder of Ahmaud Arbery, a young unarmed Black man who was gunned down while jogging in a rural part of the state. The culprits, Gregory McMichael, Travis McMichael and William “Roddie” Bryan, had chased Arbery down in pickup trucks, and the McMichaels, who were both armed, confronted him with guns while attempting to make what they described as a citizen’s arrest.

A state court had already convicted all three men of murdering Arbery and sentenced them to life in prison. Georgia subsequently passed a hate crimes law, and repealed and replaced its law governing citizen’s arrests.

The case, with its obvious parallels to the Martin case, was particularly fraught because the three culprits were not arrested until two months after the murder even though their identities were known, and then only after the case was taken out of the hands of a local prosecutor.

Frustration and hope

In an essay published this month marking the 10th anniversary of her son’s death, Fulton wrote, “Even now, a decade later, when I see the continual acts of racial violence – against George Floyd, Breonna Taylor, Ahmaud Arbery – I don’t tell people that justice is coming, because we did not receive justice.”

However, Fulton also struck a hopeful note, writing, “We are at a turning point now. Things are changing. If the protests during the summer of 2020 showed us anything, it’s that we cannot afford to be silent.”

She added, “While one generation is getting older, we need the next generation to step up to the plate and use their voice on behalf of our people. The youth have the spirit and enthusiasm, we just need to show them how and then get out of their way. The very future of our people is at stake, and there’s no room for nonsense or playing games.”

On the afternoon of this Thursday, EL TIEMPO learned that the Fourth Criminal Judge of the Sincelejo Circuit sentenced the driver Armando Quintero Ponce to 32 months for the death of Vallenato singer-songwriter Martín Elías Díaz Acosta.

The judge’s decision comes almost five years after the tragic traffic accident that occurred on the San Onofre (Sucre) – Lorica (Córdoba) road, at the height of the Aguas Negras sector.

Defender filed an appeal

Justice is done and this is a component that the family has been waiting for a long time

After hearing the conviction, the defender of Armando Quintero, Raúl Gutiérrez, filed an appeal for details that he will announce in the coming days.

“I file the appeal, which I will support within the following five days, as provided in article 179 of the Code of Criminal Procedure,” said the lawyer.

On several occasions, EL TIEMPO has tried to find out the version of Quintero’s attorney, but has received no response. For his part, Lawyer Sierra highlighted the meaning that this ruling has for the family of Martín Elías.

“It has been very painful and a heartbreaking situation for the family. Finally, after so many years, justice is done and this is a component that the family has been waiting for a long time, “he closed.

The reaction of the ex-partner of Martín Elías

After the decision of the Fourth Criminal Judge of the Sincelejo Circuit, one of the reactions that occurred was that of the singer’s ex-wife, Dayana Jaimeswho shared his feelings through social networks.

“Martín Elías stopped being with us five years ago, leaving his friends, family and followers with deep sadness and a void in vallenato music,” the woman said.

A un día del partido donde la Selección Chilena enfrentará a Bolivia por la octava fecha de las Eliminatorias Sudamericanas rumbo a la Copa del Mundo de Qatar 2022, el entrenador de la Roja, Martín Lasarte, descartó por ahora la opción que Arturo Vidal reaparezca ante los altiplánicos.

En la conferencia de prensa previa al cotejo que se jugará en San Carlos de Apoquindo, el DT uruguayo fue enfático en señalar que por temas reglamentarios el ‘King’ no tiene chance de ver acción.

 

«Hiciste referencia a la pauta más importante: hablamos de un tema de salud, por lo tanto esto tiene que ser referenciado primeramente por el tema sanitario. Desde ese punto de vista y por un tema reglamentario no estaría en condiciones de poder participar«, señaló.

Al mismo tiempo, sentenció que aunque parece ser imposible, de igual forma podría haber cambios.

La Selección Chilena a cargo del DT Martín Lasarte, presentó este martes una nómina de sólo 11 jugadores para llevar a cabo un microciclo que se realizará entre el  lunes 10 y miércoles 12 de mayo.

En los nombres destaca la presencia de en su mayoría jugadores de Colo Colo, club que cuenta con cuatro convocados.

Entre ellos sobresale la primera aparición en la Roja, aunque sea para un entrenamiento, de Leonardo Gil, argentino de nacimiento, pero con raíces en Chile.

Cabe consignar que esta nómina no considera a jugadores de Universidad Católica, Unión La Calera, Palestino y Huachipato, ya que el microciclo se realizará en días que estos clubes participarán en torneos internacionales.
