He insists that the only thing that would give him peace of mind is to be certain that justice was done for the death of these young people who were just beginning their lives.

“What I want is for that man to pay for what he did and not go free as always happens in this country,” said De Lima.

No agreements with survivor

EL TIEMPO also learned that, in the case of the minor under 14, the only survivor of the accident, an economic agreement has not been reached either for the lack of some documents and pending procedures.

To establish the amount that this family will receive for compensation, a report from the labor medical board on the state of physical and psychological health of the adolescent is required.

It should be noted that the families of Camila and Eleonir Romero, María Camina Martínez, Juan Diego Alzate and Rafaela Petit, did make arrangements with the insurer of the businessman’s vehicle and, in addition to agreeing to withdraw the criminal action against Enrique Vives, they also asked the Prosecutor’s Office to relax the conduct for which he will be prosecuted in the process against him.

The lawyer Rodrigo Martínez, representative of two of the victims, clarified that although the relatives desist from their participation in the case, the Prosecutor’s Office as an autonomous body may continue your research and accusation for the crimes that it considers pertinent.

El abogado de Enrique Vives Caballero, informó que en algunos casos «ya se firmó el contrato (con Seguros Bolívar) y con otras ya hay acuerdos».

«Los abogados de las víctimas dejarán de actuar dentro del proceso penal» en el caso de Enrique Vives, conductor implicado en el accidente mortal donde seis personas fallecieron y un adolescente resultó gravemente herido.

Su abogado, informó que ya en algunos casos «ya se firmó el contrato (con Seguros Bolívar) y con otras ya hay acuerdos».

Con esto, lo que se ha conseguido es que las familias de los fallecidos, «firmaron que renunciaba a la acción penal y en otros casos, para retirar algunos cargos».

Sin embargo, el proceso judicial sigue en curso.

Quien confirmó la información en medios de Santa Marta, fue el mismo abogado Rodríguez Martínez, quien dijo que esto no significa que Vives Caballero salga libre en este momento. Pero esto, si ayuda en su caso porque se retiran algunos cargos.

“No acepto los cargos, porque los hechos relatados no son acordes a la realidad“, dijo Enrique Vives Caballero en medio de la audiencia el pasado 19 de septiembre del 2021, cuando un juez lo envió a la cárcel.

Luego lo trasladaron a Cartagena y finalmente otro juez le permitió casa por cárcel.

Contexto

Vives es el conductor involucrado en el accidente donde murieron seis personas, la mayoría jóvenes y adolescentes, en Gaira, Santa Marta.

De este siniestro, un menor de 13 años de edad, resultó gravemente herido, estuvo en UCI y ahora, se recupera con terapias y tratamiento médico en su casa.

Al hombre, un empresario samario y que había sido candidato al concejo de la capital del Magdalena, lo detuvieron ese día tras el accidente, en estado de alicoramiento.

Hasta ahora se desconoce cuánto es el acuerdo de pago alcanzado.

En el caso del adolescente que sobrevivió se conoció que están en diálogos con la familia pero hasta ahora no se ha concretado un acuerdo de indemnización.

La Fiscalía deberá informar cómo sigue el proceso contra Vives Caballero tras estos pagos.

Although there is no economic amount that can compensate for the life that was lost, the lawyer reported that all the families, without exception, decided accept the demands that the insurance company raised in the sense of waiving the charges and the entire legal process that they were carrying out against Enrique Vives.

“It is already a fact that the victims are not going to continue the criminal action against the driver, and they also asked the Prosecutor’s Office to modify the judicial conduct from eventual intent to negligent homicide for which they must respond,” said the jurist.

In any case, it is an autonomous decision of the accusing entity if it takes into account the request of the families or maintains its position of taking Vives Caballero to trial and severely sentencing.

For the time being, as requested by the judge, the Prosecutor’s Office has already handed over to the businessman’s defense the evidence in his possession to point him out as the main responsible of the road tragedy that left six dead and an injured teenager.

The preparatory hearing is scheduled for March 3, where the accusing body and Vives’ lawyer will defend their version with evidence and technical arguments about what happened the morning of the accident on the dual carriageway in the Gaira sector.

What the government says

The head of the legal office of the Government, José Humberto Torres, said that there is currently no direct agreement with Arturo Creus.
